My PD is Feb 2008 and my I-140 has been approved the same year. I am on my H-1b 3 yr extension.
If I were to change my job now, will I lose my PD or can the new company refile my new I-140?

As all PD are now current, number of EAD filling will increase. So the processing time will be about 6 months for EAD.
My question is what will happen, if the PD retrogress before EAD is approved. Will it be still approved, or will have to wait till PD get current again.

I have filed I-485 as derivative on my spouse case with his PD of EB3 Dec2005 as his I-140 was also approved in july 2007. I have AP/EAD through it, but have never used them.
I am currently on H1B and just got my I-140 approved through my employer in EB2. My priority is Feb 2005 which is much earlier than his EB3 Dec 2005. The approved I140 has the same Alien # that I received through my pending AOS case filed earlier in july 2007..
Do you recommend filing I-485 again based on August bulletin now that my PD is current.
How does processing date working in tandem with Priority Date.
What is your take on multiple I-485 filing.

I think you are fine - if it happened more than 5 years ago, and you have completed your sentence and it wasn't a crime of moral turpitude - you should have no issues. BUT be prepared to tell the USCIS interviewer everything AND take along all the court papers etc showing you have completed your sentence - to be on the safe side.

What my lawyer said was correct. Yesterday evening received the approval email and card production email. In the case of same employer, interfiling is not necessary. USCIS took care of it automatically.

I am on H1b and work for a desi consultancy company. My project with a client ended some time ago and due to bad market, I have been so far, unable to get onto another project. Now my employer is asking me to go back to my country for some time as I dont have a project in hand. I am worried that this may result in canceling of my H1b visa. However, employer is trying to assure me that he won't cancel it. I am wondering has anybody (somebody you know) been in this kind of situation. FWIW, I do have an american undergrad degree and have been living here legally and lawfully for past nine years.

I got a RFE on my Substitute 140 ( PD is 2005) where they are asking for 2007 tax returns which are not filed yet, applied for extension. 2005 and 2006 tax returns are good.
Can someone suggest me what to do in this situation.
Any suggestions or any format leters...etc

Jason, agree with Kevin. I did take a quick look at your site however and I see you like to do landscapes. You have a good eye for composition. Some of the pics could benefit from some post processing in a graphics program like photoshop or paintshop pro. A few of the landscapes are heavy on the magenta or cyan scale, a few have washed out skies (there are techniques to deal with that). Best to post a pic in a thread for specific feedback or answers to questions you may have.

My L1 and I-94 is valid till August 14th 2009 -- I want to know if I can travel India and come back before it is expired. Are there any restrictions on port of entry when visa is nearing to expire. I would not take chance if there is a porblem in international travel and if I have deportation issues at the point of entry then I am not willing to go. But I want to visit my parents as they are not doing well.
Also, I am thinking once I am back from India then I can apply for L1 visa extension -- is it a good idea to apply for extension after I come back or I can apply and go to India for vacation.
Please guide me as I am in a fix and I am not able to take any decession.

I am in US on h1b through change of status from l1b , i am going to India on vacations , so will have to stamp my h1b visa.

1. . US point of contact information ? can i give contact of my friend or it has to be someone in my company ?

My friend has a question. His wifes H1 got approved. As of now she doesnt have job. What if she gets job in dec/Jan. There wont be any pay roll for october and november. Will this create any problem at the time of visa stamping in India if she goes for vaction later in next year.

Little bit of background. I have been working on h1 since 2003 and applied labor in Mar 2005.
I have was able to get my application with 2007 filers. Got my 140 approved last year and ead and FP done as well. My GC sponsoring company is a desi consultancy, which is helpful to a certain extent and I have been with them since 2004.
I am in a bit of a dilemma now. The client, where I have been working for last few years, have instated a new policy in which contractors must be on W2 with the vendors. Vendor I am working with is not big and like any other consultancy (Tek, comsys), will fire if you don't have a project for 15-20 days. In the past, I wouldn't have bothered even thinking about this and moved on for another project but because of recession and difficult job market and I am contemplating this move.
After doing research, I am thinking of the following strategy.
I will transfer my h1b with the vendor and will not use EAD. Plan to work with the vendor for as long as possible and when the contract ends move back with the GC sponsoring employer. I am going with assumption that the GC sponsor will not revoke my 140 (even though it shouldn't matter as I am past 180 days with 485 and 140 is approved) and when the contract ends I have something to fall back on to. Doing that could secure me if USCIS asks EVL in future and I can simply my GC sponsoring company to show that for future employment. Also, I want to keep h1b as a way to bring my wife (if and when, with divine intervention, I get married somehow).
Do you think if this is a viable solution? Any suggestion is welcome.
