Guys
Im just thinking aloud here. We want to be heard and we want to educate people as to how we are different from Illegal immigrants.
Why not post a question for the Republican debate? If our questions get selected and aired we will have 30 seconds of national television audience. We might even get some answers from some presidential candidates.
What i have in mind is get a few of us together, preferably people from different nationalities. Each one of us will hold a placard with
Legal Immigrant in bold, educational qualification, Federal tax paid, State tax paid, SSN tax paid and finally number of years in green card wait.
One person.. can then briefly mention what our issues are and ask what the candidate can do for us.
Each placard also has immigrationvoice.org on it...we have free advertising, we have airtime for free... and we have a national audience.
I know very well that the candidates answer may not directly help us.. but at least we will get some attention. Many many citizens watch the debate.

If the position you are being sponsored is 50% or more different than the position under which you have gained your experience, then experience gained in the same company can be counted. Your attorney somehow has to show that the postion you have now is more than 50% different (duties etc) than the new one. This is a tricky one and you would need a GOOOOOOD attorney to do that.

Why are you going to other forums for advice. Those other forums are after making money from traffic and ads. They want you to suffer as long as possible so that they make money. I am on a L1 visa which has expired April 2006. I have got my petition extended till 2008. Can I transfer my L1 from Employer A to another Employer B. Can employer B transfer my current L1 petition to his company?

Hello everone.
My 140 was approved in september (EB2; IN) and i belong to july 2 VB fiasco.
i was just checking my case status online and i noticed that my LUD for 140 (which has been approved) was changed to december 2007.
what does that mean?? i hope its not an RFE or rejection after approval just like some other people on the forum.
Can anyone please help me out.

Gurus,
I have labor pending from a State A, now my employer is asking me to move to State B. However, my employer is willing to keep alive, labor process from State A and is also ready to file new labor from State B. Question is if labor A gets approved and if I apply I-140 on that labor, do I have to reapply I-140 for labor B, once labor B gets approved or I can use the same I-140?
Help is appreciated.

Whether it is LCA for H1 or PERM labor for GC it is location specific, unless one filed(or able to file) AC21 after July '07 fiasco, you need to have labor to a specific job to the specific location you will be working.
Either job or the location changes you need to start allover again, in some cases you can recapture (or port) your priority date.

It is not clear if they are going to initiate a name check again. This could be associated with when your fingerprints get invalidated. If they initiate a fresh fingerprint (for what ever reason) without refreshing the existing one, that could trigger a name check. So that could be why they have a secondary check on preadjudicated cases.

with 90 days validity and I have not seen my receipts or checks cashed yet.
My lawyer replied to 90 day validity. He mentioned that if at time of sending documents if the check was valid and had not expired then application should be accepted.
Also he mentioned that with so many procedural errors being overlooked in this last July visa bulletion, this has to be looked over, since this is not a problem of candidate sending documents.
And there is nothing one can do about it, so i am thinking it will be alright.
We will be fine.

I though it would be a good idea to start consolidating all the RFE's, so that people would have one thread to look at if at all there is any RFE

2. Current address proof
3. Missing G325-A need to submit one (but I did send them initially)
4. Evidence that you maintained non immigrant status from the date of first entry till the date you filed your I 485

At the time of filing my application I just used one address.
Somehow I didn't know you could use Permanent address and current address.
You have used "one" address in I485, the same should be reflected in G325 - Consult with your lawyer.
I'm not sure but I guess my lawyer didn't file G325 form.
Is filing G325 form something mandatory ?

When checked on the USCIS site it shows the following for a reciept no which was sent by the attorney. The attorney seems to have e-filed a bunch of applications. Does the e-file reciept no sent belong to one person or a group of people filed by the attorny. If it for a group of people, how do you know if a particular persons application is in the bunch that is being recieved.
